Booking Terms & Conditions
These Terms and Conditions regulate the short-term rental agreement entered into between Harry and Jean McKerral ("we", "us", "the owners") and the person named as the lead person on the Booking Form ("you", "the lead name", "the guest"). By making a reservation with us, the lead name accepts these booking conditions on behalf of themselves and all guests included in the reservation, and confirms that this agreement will be governed by, and interpreted in accordance with, Scottish Law and that the parties hereto shall both submit to the jurisdiction of the Scottish Courts.
Booking and Deposit
Before a booking can be accepted the lead member of the party must complete and sign the booking form as indicated. In order to confirm your booking a deposit of $250/£200 will be required.
Payment of Balance
Full payment must be received 8 weeks or more prior to departure date. Failure to make payment within the specified period will entitle us to cancel the booking and claim the appropriate cancellation charges ($250/£200).
Security Deposit
Upon payment of the final invoice we will require a payment in the amount of $300/£250 as a security deposit which will cover any loss or damage to the property during your stay. This can be paid by a separate credit card charge if preferred. For parties in excess of 6 persons the security deposit will be $500/£400

You will be responsible for any damage or breakages, however caused, to the property or its contents during your stay. In the event of any charges being made, you will be advised in writing, and receipts for repairs/replacements provided.

For your peace of mind, prior to your arrival our Management Company undertakes a full inventory of the villa and its contents. This process is repeated soon after your departure and, following a satisfactory inspection we will return the deposit to you, normally within 4 weeks.

It should be noted that Florida has a sub-tropical climate and common sense should be taken with food and subsequent waste/garbage disposal. Food should never be left uncovered as this can attract insects very quickly. Food waste should be disposed of wherever possible by use of the waste disposal unit provided in the kitchen and not in the trash bins.
If you cancel your Booking
In the event of the booking being cancelled by you the following charges will normally apply:

8 weeks or more - $250/£200
6-8 weeks - 50% of total rental charge.
4-6 weeks - 75% of total rental charge.
Less than 4 weeks - 100% of total rental charge

All cancellations must be in writing, by post or e-mail.

In the unlikely event that circumstances beyond the owners' control results in the cancellation of the booking the owner or their agent reserves the right to cancel the booking and be liable only to refund any monies already paid by the guest. We will however seek, if possible, to relocate your booking to a villa of similar or superior standard.

You are advised to ensure that you have appropriate holiday cancellation, loss/damage to personal effects and medical expenses insurance cover for all members in your party.
Arrival and Departure
Guests may gain access to the property from 4 pm on the day of arrival and the property must be vacated by 10 am on the day of departure, unless otherwise arranged and agreed. Late checkout without prior approval may incur loss of your security deposit.
Access
Guests are to allow the owner or their agents the right to enter the property at any time to carry out maintenance or make emergency repairs. Wherever possible, guests will be notified prior to any necessary entry to the property.
Smoking/Pets
For the safety and comfort of all guests, smoking is not permitted anywhere inside the villa, and no pets may be brought into the property or the pool area.

Smokers may smoke on the decking area only, but it would be appreciated if the patio doors are kept closed at this time to prevent the drift of smoke into the living areas.

Smoking in the villa will result in the loss of the security deposit and you will incur additional charges to cover cleaning, repairs or redecoration.
Insects
Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. The home is treated regularly as part of a pest and termite control program. We advise you to keep all windows and external doors closed whenever possible; not only will this help to keep bugs from the property, but it will enable the air conditioning unit to function more efficiently and also restrict direct access to the pool area by small children.
Villa Occupancy
The villa is licensed for a maximum occupancy of 8 persons (plus one baby under 12 months of age). All guests must be listed on the booking form by name and age and no other persons may use the accommodation. All persons under 21 years of age must be accompanied by parents or other responsible adults.
Swimming Pool
The property has a private swimming pool and use of this is entirely at the guest's own risk. No diving is allowed. While using the pool, guests are responsible for their own safety and the Owners do not accept any liability for any injury however caused as a result of the use of the pool.

Guests are specifically required to ensure that all children are supervised by an adult at all times when in the pool area.

Glassware of any type (including bottles) is not allowed on the pool deck at any time. Plastic items are provided for use in the pool/lanai area.
Pool Heating
The use of pool heating cannot guarantee the actual temperature of the water in the pool. This is dependant on many factors, including the ambient temperature, general weather conditions, use of pool blanket, and number of people using the pool. In severe conditions, you may not be able to use the pool heating at all.

We cannot, therefore, guarantee that pool heating will actually heat the pool water to a degree comfortable enough to swim in. You must also be aware that outdoor pool heating will take the chill off the water and heat it slightly. It will not take the temperature to that of an indoor tub or spa.

It is strictly forbidden to tamper with the pool equipment. Under no circumstances are any guests to tamper with, adjust, turn or move any controls relating to the pool pump, heater or timer. Should this occur, you will automatically incur additional charges and be solely responsible for any loss or damage arising from such tampering. If you encounter any problems with the pool, please contact our Management Company for assistance.
Air Conditioning
Air Conditioning is provided throughout the property to maintain the temperature at a comfortable level, when used in conjunction with ceiling fans where necessary, and when external doors (and door to garage/games room) are kept shut.

Control of the AC unit is set centrally at a preset temperature designed to be comfortable for all guests. It is strictly forbidden to tamper with the AC controls. Under no circumstances are any guests to tamper with, adjust, turn or move any controls relating to the AC. Should this occur, you will automatically incur additional charges and be solely responsible for any loss or damage arising from such tampering. If you encounter any problems with the air conditioning, please contact our Management Company for assistance.
Cleaning / Inventory
The villa is thoroughly cleaned and inspected before and after every let, and the inventory of major items checked. On arrival, guests should check that the items on the inventory list (attached to the refrigerator) are present and in good order, and any discrepancies or damages found reported immediately to our Management Company. Guests are expected to treat the property with the same respect and care as they would do their own home. While the property is cleaned before and after each let, guests are expected to maintain a reasonable level of cleanliness during their stay. Guests should not allow any excessive build-up of dirt, rubbish etc, particularly during longer lets or when there are larger numbers of occupants. If on post-stay inspection the property is found to require an unreasonable level of cleaning to return it to its pre-stay condition (in preparation for the next guests), this will require to be charged against the security deposit. If desired, mid-stay cleans can be arranged with our Management Company at an additional cost.
Travel and Health Insurance
Guests are advised to have appropriate travel/medical insurance in force for both the period of rental and their entire holiday. All matters arising with regard to loss or injury should be directed to the respective insurance company.
Limitation of Liability
As owners of the property, we, our servants or agents will not be liable for any loss or delay occasioned by any of the following: strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, fire, flood, technical/weather problems to transport, aircraft, closure of airports for any reason whatever, or any other event beyond the owner's control.

We cannot accept liability for the sudden failure of equipment (including where the pool heater cannot reach the optimum temperature due to adverse cold weather conditions) at the property), but will take immediate and reasonable action to rectify such failure upon notification by the guest.

The owners of the property, their servants or agents, accept no liability to pay compensation in respect of any loss, damage or changes arising from unforeseeable circumstances beyond their control including (but not limited to) war, riots, civil strife, terrorist activities, natural and nuclear disasters, strikes, floods, closure of airports, adverse weather conditions or other events beyond our control.

All information supplied in brochures, emails or our website is deemed to be correct to the best of our knowledge and belief. It is provided for information only and does not form part of any contract between you and us.
Safety and Security
The owners cannot accept any liability for your personal safety during your residency of the villa. Guests are reminded to exercise care as to the personal safety of themselves and all party members.

The hot water temperature has been set for the efficient operation of the dishwasher. This means that the tap water temperature can vary from cold to very hot and it is the responsibility of all guests to ensure the safe use of hot water.

Whenever possible valuables should be left secure and out of sight. The electronic safe facility is provided for the security of documents etc. The owners accept no responsibility for the ability of the safe to withstand forced entry and any loss suffered thereby. Use of the safe facility by guests implies specific acceptance of these conditions.

When not in the villa, and on final checkout, guests must close and lock all windows and doors, including all patio doors. If the villa is left open or exposed to the elements while occupied or unoccupied during or following a guest's stay, you will be liable for damages due to unauthorised entry or exposure to the elements that would otherwise have been avoided had the villa been properly secured.

Guests must keep the details of the community and villa access codes personal and private to themselves at all times, and must not disclose these to any third party.

Free broadband internet access is provided for guests' use via their laptop with wireless capability or a wired ethernet cable. Guests are required to abide by state and federal laws with regard to restricted websites, restricted material and access by minors, and assume full responsibility for any internet activity at the villa during their stay.

Sophisticated electronic equipment is provided for guests' use and enjoyment. Use of these facilities by children must be supervised by adults at all times and any damage caused will be held to be the responsibility of the lead person on the booking form.

A variety of DVDs and computer games is provided. Parental discretion should be exercised over which of these are suitable to be watched/played by their children.

Signage is displayed throughout the property for the safety and protection of both guests and the owner’s equipment contained therein. Guests must comply with all signage - contact the Management Company if assistance is needed.
Conduct
The property is located in Sunset Lakes, which is a high quality residential community, and we ask that nothing you do during your stay interferes with the enjoyment of other holidaymakers or residents of the community. Please do not do anything that is likely to inconvenience your/our neighbours. The Sunset Lakes Community Association has strict rules concerning noise, especially between the hours of 22.00 and 08.00. No vehicles may be parked on the road overnight and RVs must be parked in the communal car park, located near the main gate, at all times. Please also observe the posted speed limits and drive through the community with care.

In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers or residents of Sunset Lakes, or damage to any property inside or outside the villa, the owners or their Management Company reserve the right to terminate your contract immediately and require you to vacate the property forthwith. The owners or the Management Company will not be liable for any costs you incur, nor pay compensation nor make any refunds to you due to this action.
Problems or Complaints
In the unlikely event that you experience any problems with the property please contact our local Management Company who will do their best to assist and rectify the matter as soon as is practically possible. Your satisfaction with your stay is paramount to us and if you consider that the matter is of a serious nature, please contact us directly within fourteen days of your departure. However, please do not leave raising any matter of concern until your return home - we will always do what we can to resolve problems as soon as is practically possible.
